Despite the statewide ban on gambling here in Texas, football season is underway and some federal loopholes have opened the door for some alternatives for those looking to make a wager.
But it's a little bit complex.
"Technically, there is a difference between single factor sports wagering, and daily fantasy" said Derek Cohen, chief research officer with the Texas Public Policy Foundation.
Basically, if you bet on one game it's considered chance, but if you play daily fantasy options that is viewed as skill. And that is the loophole that the state really hasn't responded to, or addressed.
"When it comes to the legal side looking at that, say I bet on the Texans to win, that is basically a single factor. That is betting one throw of the dice" Cohen told KTRH, "Where as if you look at daily fantasy, you're essentially betting on two or more, and that is where skill comes in."
Either way, it's still a loss for the state of Texas financially, as in losing potential income from legalized gambling.
"What could we collect in a year? That is 834.5 million" noted Cohen.
Gambling was brought up during the past legislative session, but was quickly shot down the Texas Senate.
