Abbott Calls Ruling on Immigration Law "Hopeful"

Texas Governor Greg Abbott is calling a ruling by the Fifth US Circuit Court of Appeals on a Texas law that would make illegal immigration a state crime "hopeful."

The ruling on Friday vacated an earlier ruling that SB 4 is unconstitutional. The entire court will now consider the state’s authority to deputize state police to arrest illegal immigrants.

The legislation passed in 2023, but never went into effect, as it was challenged by the left. In July, the court issued an opinion against the law, writing that “there are ‘significant complexities’ in determining an alien’s immigration status. SB 4 runs roughshod over them.”

In the dissenting opinion from July, Judge Andrew Oldham argued that “Texas is suffering irreparable injury with each day a federal court stands between the State and enforcement of its law.
