A federal appeals court has backed a lower court ruling, and ruled that most of President Trump's tariffs are illegal, but left them in place for the time being.
For now, it puts in jeopardy all of the deals Trump has made with the European Union, Japan, South Korea and other major trading partners, plus it would cancel the tariffs that Trump has imposed on China, Canada and Mexico.
The decision is not set to go into effect until October 14, which gives the Trump administration time to appeal the decision to the U.S. Supreme Court.
Trump responded on Truth Social: "Today, a Highly Partisan Appeals Court incorrectly said that our Tariffs should be removed," adding that, "If allowed to stand this Decision would literally destroy the United States of America."
The ruling from the U.S. Court of Appeals for the Federal Circuit upheld a decision in May by the U.S. Court of International Trade, which stated that president Trump exceeded his authority under the 1977 law he invoked to impose both the fentanyl trafficking tariffs, and the worldwide tariffs, under the International Emergency Economic Powers Act.
