A Federal Appeals Court Rules West Texas A&M Cannot Enforce Drag Show Ban

The radical left is celebrating, after a three-judge panel of the U.S. Fifth Circuit Court of Appeals ruled that West Texas A&M University cannot enforce a ban on drag shows.

The ruling was 2-1, and it's not the only for Texas A&M.

"There's currently a similar drag show ban that the Texas A&M system as a whole had also instituted on their campuses, especially in College Station" said Brandon Waltens, senior editor at Texas Scorecard.

At issue is whether or not West Texas A&M violated the First Amendment when it canceled drag shows in 2023 and 2024.

"None of this is final yet as it moves through the courts" Waltens told KTRH, "But it is something where I think that there probably could have been the opportunity for the legislature to spell this out a little more clearly, and actually put some legislation behind it."
As noted by Texas Scorecard, Judge James Ho wrote in his dissent:

“If we accept that people can change genders—or even if we don’t but agree to be ‘polite’ and call a man ‘she’—then why shouldn’t ‘she’ be allowed to play women’s sports or bathe naked in an all-women’s space?”

“Why shouldn’t ‘she’ be allowed to enter women’s abuse houses or be transferred to a women’s prison? Why accept one lie and not the whole thing?” Ho added.

We reached out to Texas A&M, and they said they do not comment on pending litigation.

The new trial should start in district court later this year in Amarillo.
