The Supreme Court today ruled in favor of a Texas death row inmate who wants DNA testing to prove his ineligibility for execution.

The 6-3 decision grants Ruben Gutierrez the opportunity to have evidence tested, potentially proving his innocence in the stabbing death of 85-year-old Escolastica Harrison.

Gutierrez was originally sentenced in 1998 and has since had multiple execution dates stayed.

The most recent stay was in July, when the court granted a stay of execution just 20 minutes before his scheduled lethal injection.
