The Supreme Court has heard oral arguments over the three nationwide injunctions against President Trump's executive order ending birthright citizenship. All injunctions, by the way, which are entirely there to impede President Trump's attempt to coral illegal immigration. In the end, the Supreme Court very well might rule in his favor and end these lower court roadblocks against his order. But as we know all too well with Democrats, the lawfare will never stop.
Every single turn of this administration has been met with lawsuits, temper tantrums, and Democrat's inexplicable defense of illegal aliens. Lower court judges have done 'their part' for liberals, and have issued injunctions against Trump's policies, even if their injunction has no standing. It has become more comical rather than serious.
Most of these injunctions have been filed under the Administrative Procedure Act (APA), on the grounds that Trump's order violates the 14th Amendment. That Amendment guarantees citizenship to persons born or naturalized in the United States. But when you are in the country illegally, and have a kid on U.S. soil, should not be protected under that Amendment. You are not a taxpayer and have no legal right in the country. Plain and simple.
Margot Cleveland of The Federalist says the Supreme Court's job in this ruling is focused on stopping these lower court injunctions, which it might be successful in doing.
"The problem with these nationwide injunctions is not really the problem that they are nationwide, it is that there is no case," she says.
Again, in this case, the Supreme Court is not ruling on birthright citizenship as an entity. Though, that will likely come in a matter of weeks, should the court rule in his favor on these injunctions.
But it is surprising it has taken this long. You know that if Republicans had filed this many injunctions against the Biden Administration's policies, there would have been calls of fascism, and the usual Democrat buzz words. But it's fine when they do it, and it is delusion at its peak.
"What they are doing is allowing the courts to violate the law, and exceed their jurisdiction, and that is just as bad as if Trump was violating the law. Yet, the courts do not seem to care," says Cleveland.
SCOTUS might limit the scope of these injunctions, but it will not end the nationwide lawfare by liberal judges. That is going to take a long time to rein in, as the judicial system has had freedom to do whatever they want for years.
It is a major reason why American faith in the judicial system is at an all-time low. Americans are not stupid. They see through this lawfare push pretty easily. So, the longer SCOTUS takes in ruling on this, and reining in this injunction nonsense, the more it will embolden more rogue judges to do the same. Which holds up progress for everyone.
"The more it will cause Americans to hold the entire judicial system in disregard...it is a bad look for the Supreme Court that they have let this go on for so long," Cleveland says.
A ruling on from the Supreme Court is expected by the end of June.
