It's been nearly two months since the shocking attack caught on video went viral. The daughter of Danny Gianfrancesco's daughter allegedly getting beat up by a male student and member of the football team.
But while authorities appear to be doing nothing, Gianfrancesco is still fighting, trying to change the policy that resulted in his daughter being suspended and disciplined, even though the video clearly shows she never threw a punch.
"I spoke in front of the school board again the other night" Gianfrancesco said, "It's a little ridiculous, the game that they're playing."
A game that Gianfrancesco feels like he's losing, even though he has reached out to everybody, including the D.A. and law enforcement, for help.
"They all send me back to KISD and tell me it's their jurisdiction" Gianfrancesco told KTRH, "But since they ruled it a mutual confrontation, that means that I can't press charges against this kid. It's very frustrating."
We reached out to the Katy ISD Board for comment, and they emailed us this statement:
The district is aware of the incident, which was investigated by law enforcement and remains an active case. Additionally, federal privacy laws prohibit us from sharing details regarding student discipline. The release of any additional information requires parental consent and is further restricted by the ongoing status of the case. The district does not condone the behaviors or actions involved.
And Gianfrancesco believes that the video proves, more charges need to be filed against the boy, while the charges against his daughter should be dropped immediately.
"If you defend yourself in a fight in KISD, then you also are going to get punished even if you're just defending yourself" noted Gianfrancesco, "And in my daughter's case, she never threw a punch. They need to change those policies."
As for what's next, Gianfrancesco says they are waiting on a court date.
