More judicial overreach from another Obama-appointed federal judge. This time, it’s U.S. District Judge William H. Orrick in the Northern District of California. Orrick has ruled that the Trump administration cannot withhold federal funds from "sanctuary" jurisdictions.
This follows an executive order from Trump directing Attorney General Pam Bondi and Homeland Security Secretary Kristi Noem to withhold federal funds from cities and counties that don’t cooperate with federal immigration enforcement.
Judge Orrick says that this executive order from Trump would violate the Constitution’s separation of powers principles, as well as the Spending Clause.
He said in his order, "The threat to withhold funding causes them irreparable injury in the form of budgetary uncertainty, deprivation of constitutional rights, and undermining trust between the cities and counties and the communities they serve."
