Backing the leftist U.S. District Judge James Boasberg, who issued a temporary restraining order last weekend blocking the Trump administration from using the Alien Enemies Act to deport Venezuelan nationals, a federal appellate court voted 2-1 not to issue a stay in the ruling, meaning the Trump deportation plan is on hold.
At issue was whether or not the Trump administration had the authority to invoke a 1798 wartime authority.
An Obama appointed judge and Bush appointed judge voted against Trump.
Their decision is likely headed to the Supreme Court for further review.
